MADISON, Wis. — A recently filed criminal complaint claims that a woman rejected a man’s advances multiple times in the days prior to him allegedly sexually assaulting her.
Dashawn Lomack, 24, of Fitchburg is charged with third-degree sexual assault and attempted burglary while a person was present. Both charges carry repeater enhancers.

The woman reported that she first met Lomack at a bar in September. The two exchanged Snapchat information, and he asked her if she was interested in hanging out.
The complaint claims that Lomack asked the woman to get drinks with him or meet him at his workplace multiple times in the days after they met, but she turned him down. She saw him again in the two days before the alleged assault, but they did not speak much.
The complaint alleges that on October 9 at around 2:30 a.m., Lomack walked up to the woman and kissed her on the mouth while she and her two friends were getting into an elevator in the lobby of The James. The woman reported that neither of her friends intervened, and she was uncomfortable.
She reported that Lomack then followed her and her friends inside her apartment. He was not invited in, but the woman said that she was nervous and shocked and didn’t ask him to leave at first. According to the complaint, she reported that she made non-verbal cues to her friends that she wanted Lomack to leave, but they did not respond.
At one point, Lomack allegedly followed the woman into the kitchen, grabbed her waist, kissed her neck, and tried to convince her to go to her bedroom with him. He then allegedly took her hand and walked the woman toward her bedroom.
The woman reported that she stopped in the doorway of her bedroom and tried to tell her friends that she needed help, but Lomack allegedly unbuttoned his pants and placed her hand on his genitals.
The woman and one of her friends then walked into the building’s hallway where the woman explained the situation to her friend; the two then returned to the apartment. Both of the woman’s friends left the apartment shortly after.
Once the friends were gone, Lomack allegedly took the woman by her hand, walked her back to her bedroom, and began kissing and groping her. She reported that she felt that she was going to be raped. At one point she was able to get away from him and make a phone call to a friend, which she placed on speakerphone.
According to the complaint, Lomack asked if he could sleep in the woman’s apartment. She said no, but he kept asking her to stay. At one point, she left her own apartment. She eventually returned and was able to get Lomack to leave at around 4 a.m.
The complaint alleges that video footage from the lobby at The James on the night of the alleged assault shows Lomack get off the elevator with the woman and her friends at 3 a.m. and he appears to walk with them. He is also seen leaving at around 4:18 a.m.
Alleged Attempted Burglary
A separate criminal complaint alleges that Lomack entered another apartment at The James and took money while the people inside were sleeping on the morning of October 9.
One resident said that for about 10 minutes he could hear someone going through his change drawer next to his bed. He thought it was his roommate, but when he looked he allegedly saw Lomack. According to the complaint, the apartment was unlocked.
A security camera at The James allegedly shows Lomack entering the apartment just before 5 a.m. and leaving a few minutes later.
During an initial appearance on Friday, Lomack’s cash bond was set at $7,500 for the alleged sexual assault and $2,500 for the alleged attempted burglary. A preliminary hearing is scheduled for October 25.
