MADISON, Wis. — Republican attorney general candidate Eric Toney has conceded the race to his Democratic opponent, incumbent Attorney General Josh Kaul.
A campaign spokesperson confirmed Toney’s plans to News 3 Now early Wednesday morning.
As of 1:25 a.m., the Associated Press had yet to call the race for either candidate. Kaul was leading narrowly 50.1%-49.9%.
Speaking to supporters, Kaul said he wants to make sure every vote is counted but that he remained upbeat.

Kaul was elected attorney general in 2019, narrowly beating Republican incumbent Brad Schimel. He was the first Democrat to hold the office since his mother, Peg Lautenschlager, did so from 2003 to 2007.
Toney was born and raised in Fond du Lac, where he has served as district attorney for the last decade. Throughout the campaign, he took aim at what he called failings by Kaul, including claiming that Kaul failed to fill staffing vacancies in the Division of Criminal Investigation and that the DCI has experienced case backlogs.
Kaul pushed back on Toney’s claims, saying his opponent “just doesn’t understand how this works.”
The pair debated last month.
