JANESVILLE, Wis. — Four months after a number of Rock Haven nursing home employees were laid off for refusing to get a coronavirus vaccine, they and their attorney are continuing to fight back.
Fitchburg attorney Michael Anderson told News 3 Now he has filed a $500,000 notice of claim against Rock County. Anderson called it a precursor to an actual lawsuit.
He said he is hoping the county will enter into a dialogue with him and they will be able to come to a resolution without going to court.
While Wisconsin DHS says workplace environments have the right to mandate a vaccine, Anderson said the emergency use authorization label changes things.
“There are people out there who look at my clients and say, ‘Why in the world aren’t you getting vaccinated?’” Anderson said. “I want people to recognize these are still non-fully FDA approved drugs. But for something that is emergency use, the law says you can’t enforce someone to [get a shot].”
The county has 120 days to respond to the notice of claim.
