MADISON, Wis. — Prosecutors have enough evidence to move forward with a case against a Madison man who’s accused of accidentally shooting and killing his friend earlier this year, a Dane County judge ruled Tuesday.
Twenty-year-old Isaiah Miller is charged with one felony count of homicide by negligent handling of a dangerous weapon and one count of homicide by firearm with a controlled substance.
According to the complaint filed against him, Miller admitted to accidentally fired a round from an AR-15 rifle that killed 19-year-old Marshall “Levi” Iverson.
In an interview with police after the shooting, Miller said he was “messing” with the gun and didn’t think there was anything in the clip before cocking it. Miller later claimed he put the gun on its side to uncock it before storing it away when he “clicked it” and the gun fired.
Court officials also entered not guilty pleas on Miller’s behalf as he stood mute during his preliminary hearing.
His next court appearance had not yet been scheduled as of 5:30 p.m. Tuesday.
