MADISON, Wis. — A man and woman charged with child neglect after their baby overdosed on fentanyl last year will stand trial in the fall of next year, court records show.
Derrick Hawkins, 25, and Kelsey Kindschy, 32, both of Madison, face a felony charge of neglecting a child where the consequence is death as a party to a crime.
The pair will be tried separately with Kindschy’s trial scheduled for October 2-6, 2023; Hawkins’ trial is scheduled for October 16-20, 2023.
Hawkins and Kindschy were arrested in September of this year, more than a year after their child died.

The pair brought the child to a local hospital on July 20, 2021, after Kindschy found the girl with snot and blood coming from her nose, according to a criminal complaint.
The complaint said Kindschy had left the child home with Hawkins earlier that day when she left to meet with another man. When talking to police, Kindschy reportedly said the baby was still on her back as she had left her but was “kind of cold” when Kindschy returned home.
The man Kindschy met with later told police he had sold crack cocaine to Hawkins and heroin to Kindschy, both on the day the child died. Hawkins later told police he was in the bathroom the entire time Kindschy was gone. Kindschy later said he may have been “shooting up,” according to the complaint.
According to the autopsy cited in the criminal complaint, the baby had 52 ng/ml of fentanyl in her blood when she died, which is 13 times the amount that’s considered fatal for an adult. The complaint did not provide specifics on how the baby might have ingested the drugs responsible for her death.
Hawkins and Kindschy will both appear in court on May 5, 2023, for a motion hearing.
