MADISON, Wis. — The Wisconsin Supreme Court is rejecting a motion filed by a conservative law firm looking for an injunction that would have temporarily blocked Dane County’s mask mandate.
In a 4-3 decision with the deciding vote coming from conservative Justice Brian Hagedorn, the court rejected the Wisconsin Institute of Law and Liberty’s request for original action over the latest mask mandate.
WILL argued that another recent Supreme Court decision blocking Public Health Madison & Dane County’s ability to shut down all schools in the county meant PHMDC also did not have the authority to institute another county-wide mask mandate. They wanted the Court to put the mask mandate on hold while they reviewed PHMDC director Janel Heinrich’s powers to do so.

The majority did not write an opinion on its ruling, but in similar cases in the past had indicated these issues needed to be taken up by lower courts before the Supreme Court could weigh in.
Conservative justices Annette Ziegler, Rebecca Bradley and Patience Roggensack dissented in the decision, arguing it should be the Supreme Court’s responsibility to provide clarity on the law.
