MADISON, Wis. — A man who police said shot and killed a home intruder last Friday now faces charges after police allegedly found drugs in his apartment while investigating the shooting.
Jose Gomez, 27, is charged with possession with intent to deliver THC, possessing a firearm as a felon, maintaining a drug trafficking place and misdemeanor bail jumping. His wife, Shauniquah Gomez, 26, is also charged with maintaining a drug trafficking place.
Madison police said a masked intruder was shot and killed inside the Gomez’s apartment on Madison’s north side on the morning of August 26. In a release shared late Wednesday morning, the Dane County Medical Examiner’s Office identified the intruder as 35-year-old James Turner of Madison.
Police Chief Shon Barnes said Wisconsin’s Castle Doctrine may protect the couple from charges related to Turner’s death.

A criminal complaint filed with the Dane County Circuit Court on Monday alleges that Jose Gomez was seen carrying a white trash bag outside the apartment when police arrived. When asked by police to stop, he turned and went back inside. He later told police that he hid the bag under his bed. He allegedly admitted that the bag had marijuana in it.
Gomez initially told police his wife had shot Turner using a gun that his brother gave her as a gift. He said his wife has multiple guns for self-defense because he is not allowed to own guns.
Gomez allegedly admitted to police that he sold marijuana and that he had “too much” weed in his apartment at the time of the shooting. He reportedly told the police that he believed Turner was looking to steal the drugs or money.
During a second conversation, however, Gomez allegedly admitted that he shot Turner, not his wife. He told detectives that he can’t buy a gun, so his brother gave him one. He allegedly admitted to having five pounds or more of marijuana in the home and $5,000.
Gomez also allegedly admitted to having sold drugs including mushrooms, prescription pills, and ecstasy in the past year, making about $20,000 in cash in the deals.
During a search of the apartment, detectives allegedly found drug paraphernalia, materials used to package drugs for retail sale, about 120 Adderall pills, and 11 grams of ecstasy. Detectives also allegedly found more than 22 pounds of THC in various forms, including gummies, liquid, and concentrate.
During an initial appearance in Dane County court on Monday, Jose Gomez’s cash bond was set at $1,000 and the court entered not guilty pleas to any misdemeanor counts. An initial appearance for Shauniquah Gomez is set for October 27.
